Employing a full-time or live-in caregiver at home involves both legal and humanitarian responsibilities. To prevent disputes that may arise in the future, everything must be official and transparent from day one.
Permits for Foreign National Caregivers
If you are going to work with a foreign national caregiver (e.g., Filipino, Uzbek, Turkmen), you must ensure that the person legally resides in Turkey (Residence Permit). Then, a Work Permit must be obtained by applying to the Ministry of Labor, and their insurance must be started. The penal sanctions for employing illegal workers are quite heavy.
What Should Be in the Employment Contract?
- Salary and Payday: The net salary amount and which day of the month the payment will be made to which bank account should be clearly stated.
- Job Description: It should be clarified whether the caregiver will only take care of child/elderly care or will also help with general cleaning and cooking in the house.
- Days Off: Live-in caregivers legally have the right to 1 uninterrupted day off per week (usually 24 hours). Also, annual leave and public holiday working conditions should be discussed from the beginning.
